Moving into an assisted living facility or nursing facility doesn’t mean a person gives up their rights. Federal and state laws guarantee rights specific to nursing facility residents, and state law protects rights specific to assisted living facility residents.

State Laws Regarding Residents’ Rights

Federal and state laws guarantee rights specific to nursing facility residents, and state law protects rights specific to assisted living facility residents.

Residents have a right to a dignified existence, self-determination, and communication with and access to persons and services inside and outside the facility. A facility must protect and promote the rights of each resident.

Nursing facilities and assisted living facilities should care for its residents in a manner and in an environment that maintains or enhances each resident's quality of life.
